Viza subclass 457 je ono sto te interesuje mada poslodavac preuzima mnogo odgovornosti za tebe. Ne znam kako ce te testirati bez da odes u Australiju (ili da on dodje kod tebe) ali predpostavljam da cete to vec nekako resiti. Dosta Filipinaca su dosli u Australiju na tu klasu vize i to su resile velike firme tako da su otisle u Filipine i tamo ih testirali za znanje jezika i poznavanje posla i onda su im oni sve obezbedili. Tako nesto se isplati poslodavcu samo ako se radi o vecem broju radnika. Ponekad angazuju za te poslove neke posrednike koje ce im to sve odraditi jeftinije nego da salju nekog Australca.

Zbog sve vece krize, ova vrsta vize postaje sve vise tema razgovora izmedju Australijske vlade i sindikata koji se protive dolasku stranaca u Australiju posto nezaposlenost raste.

Widely held community and union concerns about the exploitation of 457 visa temporary migrant workers have been confirmed by a report released on November 14.

An independent review, conducted by industrial relations commissioner, Barbara Deegan, has found that “many subclass 457 visa holders are potentially vulnerable to exploitation as a consequence of their temporary status”.

The 457 visa ostensibly exists to enable business to access workers with skills that are not available in the permanent resident workforce. However under the Howard government, the use of temporary migrant workers skyrocketed as employers sought to access large numbers of cheap and vulnerable migrant labour.

Despite the Rudd government’s stated preference for permanent migration the temporary migrant worker scheme now rivals it with 58,000 primary 457 visas granted in 2007/2008. A further 50,000 secondary visas were granted to spouses and dependants.

A submission to the review from the Australian Human Rights Commission said workers on 457 visas had complained of not being paid overtime, working longer hours than permanent resident workers, having limited access to sick leave, dismissal if the worker takes sick leave and employers overcharging for accommodation.

The report notes examples of workers who, after asking about the pay and conditions or union membership, have been sacked by their sponsor and put on the next plane ’’home” as an example to other workers.

The review was commissioned by immigration minister Chris Evans as part of a pre-election government commitment to overhaul the notorious visa category.

A key recommendation of the report is to introduce a requirement for employers to pay genuine market rates. The recommendation is designed to limit the ability of employers to use the scheme to undermine wages and conditions.

Recent government data shows that 457 visa tradespersons on average earn more than $10,000 per year less than the average Australian tradesperson.

The report also recommends extending the period temporary migrant workers have to find an alternate sponsor from 28 to 90 days. Another proposal is to increase access to on-shore permanent residency applications for 457 visa workers.

Currently, workers often rely on the promise of future employer sponsorship for permanent migration. The report notes that ’’where a visa holder has permanent residency as a goal, that person may endure, without complaint, substandard living conditions, illegal or unfair deductions from wages, and other similar forms of exploitation”.

Also recommended is a levy on employers to cover the cost of accessing the public health system.

Currently 457 visa workers are not able to access the public system despite paying tax (although they are exempted from paying the Medicare levy).

They are solely reliant on their employer to cover medical costs, including those of their dependants. This recommendation would serve to prevent a repeat of cases where employers have placed pressure on workers to avoid medical paying costs.

Evans has rejected this recommendation stating that “the Rudd Government believes it is important that temporary skilled overseas workers do not place an additional burden on Australia’s public health system”. However, the actual proposal is to place this cost burden on the employer, not the taxpayer.

Employer groups are preparing to hit back against the recommendations, concerned that their easy access to the cheap labour enjoyed over the last decade may be stemmed.

Australian Industry Group chief executive, Heather Ridout, told the November 14 Sydney Morning Herald that “serious cost burdens remain in the recommendations," and urged a “more balanced approach be adopted."

The recommendations will be considered by the government ahead of a series of reform proposals in 2009. Legislation is currently before the senate that will enable greater regulation and civil penalties for employers that breach visa obligations.

While reform to the 457 visa scheme is likely, the government has made it clear that some crucial changes are not on the table.

The government will not grant 457 visa workers full mobility to seek employment within the Australian workforce. The basic right to leave your employer and look for another job is not available to temporary migrant workers. Those who try to do so face losing their work rights in Australia and subsequent deportation.

This restriction is the root cause of the grossly exploitative practices of many bosses.

The release of the report follows the death of a 457 visa worker at Byrne trailers in Wagga Wagga in September. Lian Ron Xia, a welder from China, died as a result of a head injury sustained at work.

Australian Manufacturing Workers Union (AMWU) organisers had attempted to gain entry to the site on two occasions prior to the tragedy. They were denied access by the employer Michael Byrne according to the November 11 SMH. Lian’s death is the subject of a Workcover NSW investigation and coronial inquiry.

According to the SMH, the Department of Immigration and Citizenship has stated that nine migrants on 457 visas have died in workplace-related accidents between January 1, 2006 and October 31 this year.

The SMH quoted research conducted by Immigration Ananylst Bob Kinnard which reveals that the fatality rate among 457 visa workers was 5.8 deaths per 100,000 people in 2007. This compares with three deaths per 100,000 workers nationally.

Concerns exist that the higher rate is a result of 457 visa workers being forced to work in unsafe conditions.

Three unions — the Australian Nursing Federation, the Construction Forestry Mining and Energy Union and the AMWU — have launched a united campaign to refocus public attention on the exploitation of temporary migrant workers. The unions organised a delegation of 457 visa workers to parliament in Canberra on November 10.

The delegation of five workers met with Evans to explain their experiences of exploitation by their sponsoring employer.

A joint sign-on statement launched by the unions concludes “we stand for equal rights for all workers regardless of their origin, including the right to stand up to voice concerns and to change employer without fear of deportation. An expanded reliance on temporary migration schemes where workers have diminished rights can’t secure this”.

Ukratko ne.
Postoje mislim 5 vrsta privremenih i 3 stalne radne vize ali se one zasnivaju na poslodavcu koji garantuje za tebe ili potpisuje ugovor sa tobom, ili ti dolazis kao predstavnik kompanije koja ima predstavnistvo u Australiji.. Verovatno to on zna jos bolje nego mi i zato ti je predlozio da dodjes na turisticku pa ce onda videti.

Pored troskova dolaska dva puta u Australiju, situacija se u Australiji pogorsava sto se tice radnika u smislu da je do nedavno bilo tesko naci radnika a sada pocinju sve vise otpustanja pa ce biti nezaposlenih strucnih radnika na pretek.

Ovo ti sve govorim iz razloga posto iako odes u Australiju na turisticku vizu, zadovoljis potencijalnog poslodavca (usput i krsis zakon posto ti nije dozvoljeno da radis sa turistickom vizom, cak ni da voluntiras), dok se ti vratis, poslodavac pripremi svu dokumentaciju za tebe, ti takodje, uplati neki depozit/garanciju drzavi, moze svakog trenutka da se predomisli i odustane od tebe.

Employer Eligibility under the 457 visa program - Getting Standard Business Sponsorship (SBS) Approval

An employer needs to be approved as a sponsor in order to employ skilled workers from overseas. The following requirements must be met for an employer to become a sponsor.

Lawfully and actively operating business

The employer must be lawfully operating a business that is actually and actively engaged in business activities.

Direct employer of the employee

The sponsor must be the direct employer of the employee. The direct employer is usually responsible for such things as:

· superannuation
· conditions of employment
· day-to-day supervision of the employee.
Good business immigration record

To meet this requirement:
· there must be nothing adverse known about the business

Benefit to Australia

The employment of skilled workers from overseas must benefit Australia. This could be demonstrated if the 457/SBS employment will:
· provide employment for Australian citizens or Australian permanent residents

· improve business links with international markets
· improve competitiveness within the sectors of the Australian economy
Advance skills of existing workforce

The 457 employer must also demonstrate that their Australian business operations will meet one of the following requirements:
· introduce, use or create new business skills
· introduce, use or create new or improved technology
· have a satisfactory record of, or a demonstrated commitment towards training Australian citizens and Australian permanent residents.
Overseas business sponsors

Employers with a business that has no formal operating base or representation in Australia, may apply to bring employees to Australia to do one of the following:

· fulfill obligations for a contract or other business activity in Australia.
Under the 457 visa program, Overseas Business Sponsors do not need to be operating in Australia but must meet all other employer eligibility requirements.

o any change to the information that contributed to the 457 employer's ability to be approved as a 457 sponsor or the approval of a 457 nomination
· cooperate with the DIAC's monitoring of the business or of any sponsored employees. This undertaking continues until the earlier of the following.
o o when the 457 employee leaves Australia and their visa ceases, or when the 457 employee is granted another substantive visa
o o when the sponsoring 457 employer ceases to be an approved sponsor of the 457 employee.
457 Employers must comply with the terms of the nomination
· notify DIAC of any change in the employee's work location (if the approval of the nomination is granted on the condition that the employee must be working in a particular location).
457 Employers must comply with workplace relations laws
· comply with all relevant laws relating to workplace relations and any workplace agreements that have been put in place for the 457 employee
· ensure that the 457 employee holds any license, registration or membership that is mandatory for the performance of their work
· make superannuation contributions required for employees while they are employed by the business
· deduct tax installments and make payments of tax for the 457 employee while they are employed by the business.
Results of non-compliance

Penalties may be sanctioned if the business does not comply with these 457 obligations.

457 Employee Obligations

The employee must notify DIAC of any change in their circumstances.

If the 457 sponsor ceases the 457 employee's employment, the employee must do one of the following:
· find another 457 employer who is willing to sponsor them and apply for another 457 visa;
or
· apply for another type of substantive visa;
or
· leave Australia within 28 days.
Visa conditions that may attach to the 457 visa

If the 457 visa application for a temporary 457 visa is approved, the following work condition will be applied to the 457 employee.

The 457 employee must not:
· stop working for the employer who sponsored them (that is, become unemployed or change employer)
· work in a different position other than the position that was nominated in the visa application
· work for another person or for themselves while working for the 457 sponsor.
If an 457 employee wishes to change employer, a new 457 sponsorship and 457 visa application will be required.

Conditions attached to regional concessions to the 457 visa grant

If the 457 visa was granted for a position which has been certified by a Regional Certifying Body, the 457 employee must remain in regional Australia. If the 457 employee is found to be living or working in a non-regional location then their visa may be cancelled.

Ovo sve sam ti nasao na Internetu, sto znaci da nemam prakticno iskustvo sa tom vrstom vize ali se zadnjih godina puno prica i pise o toj vrsti vize.

Citava prica oko 457 vize traje vise godina i moze da se podeli u nekoliko faza:

1. pre nekoliko godina kada je sve to pocelo, poslodavci su se zalili na previse birokratije i predug proces, a oni su bili ocajni da nadju radnike.
2. Onda se malo popravilo i uglavnom su rudarske kompanije dovele dosta radnika mada su i razne farme takodje uspele u tome. Ali onda su pocele price i zalbe na placanju mnogo manjih plata takvim radnicima u odnosu na Australijske radnike, neki poslodavci su se ponasali kao robovlasnici i terali strucne radnike da rade svaki dan po ceo dan i to najcesce nestrucne poslove.
3. Trenutna faza je da se sada sindikati jako bune da se ukine ova viza posto Australijski radnici ostaju bez posla a Australija uvozi 'strane' radnike.

Bilo bi dobro kad bi ti odgovorio neko ko je otisao na takvu vizu u Australiju.

Nadam se da te nisam razocarao. Samo sam pokusavao da pomognem.

PS: Ne znam koliko proces traje ali prema broju obaveza obe strane, dosta, ali i to zavisi koliko se i jednoj i drugoj strani zuri i koliko ce brzo odraditi svoj deo posla.

Ni slucajno ne nudi nikakve pare da mu posaljes da mu nadoknadis troskove oko tebe.
Kao sto vidis iz mojih prethodnih poruka, najveca briga za poslodavca je da ti dodjes, i na kraju ugovora ili cak i pre da jednostavno nestanes, pa te posle policija i DIMIA traze, pa kad te nadju prvo te smeste u jednu 'prijatnu' ustanovu, pa te onda o njegovom trosku prvim avionom posalju nazad. Naravno, on ce platiti i troskove tvog pronalazenja. Dodatne komplikaciju su jos i ako se ti razbolis ili povredis. Onda nastaju pravi problemi. Jedan dan u bolnici je najmanje $1,000 i to pod uslovom da nemas nikakvu operaciju. Pogadjas, on to mora da plati.

I mogu reci da je plata niza nego da si Australijanac, i da imas dodatne troskove koji nigde nepisu, medicinsko osiguranje placas ti (komplet puno osiguranje kosta oko 360$ mesecno za celu porodicu), placas veci porez, nemas pravo na nikakve dodatke i pomoci od strane drzave, ako dete ide u skolu ili u obdaniste ti placas 3 puta vecu cenu od normalne (jer su cene za Australijance subvencionisane od strane drzave), konkretno za obdaniste ti treba 75 $ dnevno sa 457 vizom a oziju treba 20-25 $ dnevno (mozda cak i manje). Jos nesto ako dolazis onim principom da dodjes i zaradis i odes - zaboravi. Na svakom cosku ces da platis sve sta ti treba, jako su male sanse bilo sta da ustedis. Mislim mozes da zivis normalnije nego u Srbiji i posle nekog vremena mozes da apliciras za permanent rezidesn i time postanes prakticno ozi jer imas ista prava kao i oni sto ti otvara vrata. Mislim da vredi izdrzati prvih godinu dve sa malo vecim pritiskom radi bolje situacije na kraju.

Pitanja se odnose na sledeće stvari, da krenemo redom:

1. Kao što sam već napomenuo da radim na mašinskom održavanju rudarskih mašina, želim da pitam sledeće:

- ja sam završio srednju mašinsku školu, i radim u struci.Radim na mašinskom održavanju rudarskih mašina na jednom ovdašnjem površinskom kopu.Imam na poslu neko zvanje mašinskog nadzornika.Šta bi, i kako bi trebalo ( odnosno sa koje strane da krenem) kako bih verifikavao te naše papire na njihove standarde, i da li za to treba nekome da se obratim......recimo spominju se neki agenti za takve stvari.Da li bi trebalo da krenem tim putem ili drugačije

- Sledeća stavka koja je za mene veoma bitna jeste finansijska konstrukcija cele ove da tako kažem operacije.Odnosno pitam sve Vas koliko je potrebno novca za sređivanje papira, i šta sve treba oko toga.

- Zatim, da li postoji mogućnost da tamo idem sa već unapred obezbeđenim zaposlenjem, ili se to radi na drugi način

Mislim da bi za sada to bilo to.Imam dosta pitanja, ali zbog gužve ne bih sve Vas trenutno zamarao.Nadam se da su moja pitanja koliko toliko jasna, i da znate o čemu pričam.Bio bih zahvalan svima Vama kada biste mi ukazali na pravi put.

Ja mogu da kazem da mozes da krenes u trazenje posla preko interneta i da u medjuvremenu sam krenes u procedure za iseljenje. Posto procedure za iseljenje traje dugo a u medjuvremenu dok ti skupljas papire mozes da naletis na nekoga ko ce da ti ponudi posao. Trenutno za posao su sanse djene-djene, jer su velike rudarske kompanije u krizi i odpustili su nekoliko hiljada radnika :( sto nije dobra vest za tebe. Ali nelezi vraze uvek treba geldati da se ponekad u tom moru nadje i makar mali camcic za spavsavanje. A vreme za dobijanje iseljenicke vize traje od 12-24 meseca, to je proces u kome ti nabavljas papire koji ti trebaju, saljes ih u Oz, i vreme za njihovu odluku. Sve ovo mozes da nadjes u postovima vec iskusne gospodje Palme i drugih, tu je gosn Topaz, i Tree i H. Love, i bodkaz, i medabozanin i ostala druzina. na tebi je koliko ces da sledis uputstva koja su doticni ostavili na forumu, ali po mom misljenju sva uputstva su za 5+. Pozdrav

Drzgan,imam pitanje za tebe...pisao si da si na vizi 457..imamo poslodavca koji je spreman za sponzorstvo...nismo još krenuli u samo apliciranje,krećemo za nekoliko dana.
Iz tvojeg iskustva,koliko si dugo čekao od apliciranja do samog lupanja vize?
Mi planiramo u Western Au,u manje mjesto...Suprug bi bio nosioc vize,a ja i dijete uz njega...
I još nešto,postoje li neke beneficije prilikom kupovine osnovnih stvari za život (opremanje stana i slično) ili se to odnosi samo za Australske državljanine?
Koliko si ti dugo tamo i kakvi su tvoji dojmovi?

Dvojac, tj. mi, je jedna vanbracna zajednica,skoro pa institucija u nasem krugu prijatelja jerbo ovaki opstajemo vec 10 godina :lol: (to napominjem jer cu kasnije kad ponovo prelistam sve, pitati o dokazivanju tog naseg statusa )
Engleski nam nije problem, immi.gov.au listamo vec dugo, sad smo konacno pregledali i razne forume, a opet, vrlo je moguce da smo nesto i propustili.. Dugo pricamo o odlasku, ali smo tek sad prionuli na posao jer sam ja tek sada zaista resila da idem ( jer sam vezana za sestrice i uopste celu bosanskodalmatinsku rodbinu, sta cu :)

Ono sto nas muci, za sada, je par stvarcica..
Ako ispadne da pored cetvoro ociju nismo videli sta pise, unapred se izvinjavamo:rumenko:

1. ja sam secondary applicant, i da bi smo dobili dodatnih 5 poena (a sada ih imamo 120, dakle, dovoljno za Skilled Independent), moram dobiti pozitivnu procenu diplome. Buduci da sam filolog, procenu radi NAATI. No, pitanje je sledece - razumela sam da ako polazem taj famozni ispit (On demand test) postajem njihov clan, sto bi automatski znacilo da mi priznaju zanimanje sa SOL-a kao prevodioca.
Da li sam u pravu ili moram posebno slati diplomu na procenu?

1a. Takodje, koji je minimalni broj poena na IELTS potreban da bi me primili da polazem NAATi test? sada imam 7.5 ali je to b ilo bez pripreme, da sam znala zalila bih se na speaking jer mi je na pravdi boga dala 6 :dash:

Za 'drugog aplikanta' Ne TREBA assessment. Imate li dovoljno bodova za prolaz? Ako imate i ne fali vam, možda 5 poena, ne radi to
--malo sam se tu zbunila, jer kontam da je bolje imati sto vise poena, no, mozda to nije tako bitno...Mada verujem da je na to tesko odgovoriti, kako sam shvatila iz vasih pisanija, ipak je sve na kraju do CO-a ....

3. moj dragi je glavni aplikant, po zanimanju geodetski inzenjer -Surveyor (Visa geodetska skola), iskustvo nije problem, kao ni engleski, no pitanje je sledece-
procenu mu radi ISA, i tamo traze da navede clanstvo,ako ga ima, u strukovnom udruzenju i sl.
Da li smatrate da to bitno utice na ishod?
On ce tek sad polagati drzavni ispit i prijaviti se u Udruzenje, iako je davno zavrsio skolu 2004-te (do sada nije smatrao potrebnim jer od tog clanstva ovde ionako ima slabe vajde).
Ah da, da napomenem da je po novom on sa MODL presao na CSL listu :super:

Pitanje za pseudonima da li je njegovo zanimanje bilo na listi kad je trazio sponzorstvo regije ili mozes sam da im se nudis ako tvog zanimanja nema nigde?
Zanimanje je veterinarski tehnicar.
 
Za one koji su spremni za zive par godina u ruralnim delovim Zapadne Australije i da na neki nacin budu sponzorisani od strane vlade Zapadne Australije, pogledajte sajt:

To je web sajt od agencije (Small Business Development Centre - SBDC) koja se bavi unapredjenjem malog biznisa u Zapadnoj Australiji i kao takva dobija sva sredstva od vlade Zapadne Australije. Oni imaju jednu sekciju koja se bavi imigracijom i mogu da pomognu ili da daju savete.

Ne znam mnogo o njima osim sto svoje usluge nude besplatno i nisu profitna organizacija. Posetio sam ih par puta ali ne u vezi useljenja.

Imaju par dobrih brosura koja mozda mogu nekome pomoci oko dolaska u Au, ali samo za one koje zele da dodju u Zapadnu Australiju.

Cao. Jeste, bilo je na listi. Nemoguce je doci preko GSM programa (za strucne radnike koji nemaju garantovan posao i poslodavca da ih sponzorise) ako zanimanje nije na SOL listi. Za privremenu radnu vizu postoji neka druga lista i verujem da se moze pronaci na zvanicnom sajtu DIAC -a (cuveni immi.gov.au). To bi bilo to...

izvinjavamo se,mlogo se izvinjavamo.. pocela sam zaboravljati i ono sto sam procitala.. :rumenko:
