Glupost,visoki predstavcnici su "doneli" stotine zakona i drugih opštih i pojedinačnih pravnih akata koji nikad nisu potvrđeni u PS BIH ni parlamentima Srpske i MHF pa se primenjuju na isti način kao i da jesu.Svaka ta odluka visokih predstavnika sadrži i odredbu o obavnoj primeni i objavljivanju u službenom glasilu kao nalog nekom od parlamenata da ih usvoji u istovetnom obliku.Po tumačenju visokih predstavnika neusvajanje u parlanemntima čini te akte visokog predstavnika manje obavezujućim.

In the exercise of the powers vested in me by Article V of Annex 10 (Agreement on Civilian Implementation of the Peace Settlement) to the General Framework Agreement for Peace in Bosnia and Herzegovina, according to which the High Representative is the final authority in theatre regarding interpretation of the said Agreement on the Civilian Implementation of the Peace Settlement; and considering in particular Article II.1. (d) of the last said Agreement, according to the terms of which the High Representative shall “Facilitate, as the High Representative judges necessary, the resolution of any difficulties arising in connection with civilian implementation”;

Recalling paragraph XI.2 of the Conclusions of the Peace Implementation Conference held in Bonn on 9 and 10 December 1997, in which the Peace Implementation Council welcomed the High Representative’s intention to use his final authority in theatre regarding interpretation of the Agreement on the Civilian Implementation of the Peace Settlement in order to facilitate the resolution of any difficulties as aforesaid “by making binding decisions, as he judges necessary” on certain issues including (under sub-paragraph (c) thereof) “measures to ensure implementation of the Peace Agreement throughout Bosnia and Herzegovina and its Entities”;

Recalling further paragraph 12.1 of the Declaration of the Peace Implementation Council which met in Madrid on 15 and 16 December 1998, which made clear that the said Council considered that the establishment of the rule of law, in which all citizens had confidence, was a prerequisite for a lasting peace, and for a self-sustaining economy capable of attracting and retaining international and domestic investors;

Recalling in addition paragraph 3 of Annex II (Rule of Law and Human Rights) to the last said Declaration, according to which the establishment of judicial institutions at the State level, which meet an established constitutional need to deal with criminal offences perpetrated by public officials of Bosnia and Herzegovina in the course of their duties, and with administrative and electoral matters, is a precondition for the establishment of the rule of law in Bosnia and Herzegovina;

Recalling finally the Declaration of the Peace Implementation Council which met in Brussels on 23 and 24 May 2000, and the Annex thereto, pursuant to which the adoption of a Law on a Court of Bosnia and Herzegovina was envisaged by September 2000;

Noting therefore that a Court of Bosnia and Herzegovina providing for judicial remedies in matters which lie within the competence of the State of Bosnia and Herzegovina under the Constitution of Bosnia and Herzegovina is a pre-condition for the establishment of the rule of law in the State of Bosnia and Herzegovina;

Considering that the guarantee of judicial remedies in fields including citizenship, foreign trade and investment, will ensure legal certainty, and that such certainty is urgently needed for the establishment of a functioning economy throughout Bosnia and Herzegovina, so that new perspectives for the citizens of Bosnia and Herzegovina for their future life in their home country may be opened up;

Stressing the need for judicial remedies to exist at the State level within Bosnia and Herzegovina which comply with guarantees enshrined under the European Convention on Human Rights which itself forms part of the Constitution of Bosnia and Herzegovina and enjoys priority over all other law in Bosnia and Herzegovina;

Considering that a working group, chaired by the Ministry for Civil Affairs and Communication, and composed of members of this Ministry, the Ministries of Justice of the Federation of Bosnia and Herzegovina and of the Republika Srpska, and of the Office of the High Representative, agreed on a draft text of a law on a Court of Bosnia and Herzegovina, on 5 October 2000;

Considering further that the said agreed text was itself based on a Council of Europe Venice Commission draft law on a State Court of Bosnia and Herzegovina, of 16 June 2000, adapted as appropriate by the said working group to the legal framework and requirements peculiar to Bosnia and Herzegovina whilst retaining in substance the said Venice Commission draft;

Regretting that notwithstanding the matters aforesaid, which should have enabled the Council of Ministers of Bosnia and Herzegovina and the Parliamentary Assembly of Bosnia and Herzegovina to have passed the said Law on a Court of Bosnia and Herzegovina through the regular procedure before the elections on 11 November 2000, the said Law has not been adopted;

Mindful both of the urgency and of the need to establish a Court of Bosnia and Herzegovina for all the reasons as aforesaid and in order to protect the interests of the citizens of Bosnia and Herzegovina.

Having considered, borne in mind and noted all the matters aforesaid, I hereby issue the following Decision which shall enter into force with immediate effect on an interim basis, until such time as the Parliamentary Assembly of Bosnia and Herzegovina adopts this Law in due form, without amendments and with no conditions attached.


DECISION


The Law establishing the Court of Bosnia and Herzegovina shall be as set out in the annex to this my Decision herein. This Law shall be published without delay in the Official Gazette of Bosnia and Herzegovina and in the Official Gazettes of the Federation of Bosnia and Herzegovina and of the Republika Srpska.

The Law on the Court of Bosnia and Herzegovina shall enter into force eight days after its publication in the Official Gazette of Bosnia and Herzegovina.

Ti i Cicko ste od cele poruke na engleskom uspeli da razumete samo datum.Eh sirotani siroti :rotf::rotf::rotf::rotf:.Taj "zakon" je visoki predstavnik usvojio 2000 a kasnije je donosio izmene i dopune istog.Za neke od tih izmena i dopuna glasali su Dodikovi posaylnici 2003.
NIsi razumeo.Nevažno je potpuno da li je taj zakon usvojen i u parlamentu.Zakoni i druge odluke visokog predstavnika stupaju na snagu osmog dana od objavljivanja u službenim novinama.
Drugim rečima taj sud bi postojao u potpuno istom obliku i da nisu potvrdjene te izmene 2003 godine uz parlementu.

Bearing in mindthe reinvigorated strategy for judicial reform to strengthen the Rule of Law efforts in Bosnia and Herzegovina in 2002/03 which was endorsed by the Steering Board of the Peace Implementation Council on 28 February 2002 and noting that the aforementioned strategy was devised in response to calls by the authorities in Bosnia and Herzegovina for firmer International Community actions to tackle economic crime, corruption and problems inherent in the judicial system;

Notingthat the Steering Board of the Peace Implementation Council in Sarajevo on 7 May 2002 called upon the local authorities to ensure the rapid establishment of the Court of Bosnia and Herzegovina reminding the Bosnia and Herzegovina authorities that the Appellate Division of the Court needs to be operational in order to adjudicate election complaints and urging the authorities to immediately find a sustainable solution to the problem of the location of the Court;

Noting further that the communiqué of the Steering Board of the Peace Implementation Council issued at Sarajevo on 31 July 2002 stated that the Board welcomes the creation of the Special Chambers and endorses the proposal of the High Representative to include national and international Judges and Prosecutors in a Special Panel/Department for Organized Crime, Economic Crime and Corruption in the Court of Bosnia and Herzegovina and the Prosecutor’s Office of Bosnia and Herzegovina;

Bearing in mindthat criminal activities continue to infringe on the economic, fiscal, commercial and other social rights and interests of the citizens of Bosnia and Herzegovina and that the establishment of a Special Panel for Organized Crime, Economic Crime and Corruption within the aforesaid Court of Bosnia and Herzegovina will advance the robust fight against crime in Bosnia and Herzegovina;

Convinced ofthe vital importance to Bosnia and Herzegovina of ensuring that the rule of law is strengthened and followed in order to create the ground for economic growth and foreign investment;

Mindful thereforeboth of the urgency and of the need to establish the Special Panel for Organized Crime, Economic Crime and Corruption in the Court of Bosnia and Herzegovina and for all the reasons as aforesaid,

I hereby issue the following
 
DECISION

Enacting the Law on Amendments to the Law on Court of Bosnia and Herzegovina, which is hereby attached as an integral part of this Decision.

The said Law shall enter into force as a law of Bosnia and Herzegovina as provided for in Article 11 thereof on an interim basis, until such time as the Parliamentary Assembly of Bosnia and Herzegovina adopts this Law in due form, without amendment and with no conditions attached.

This Decision shall come into force forthwith and shall be published without delay in the Official Gazettes of Bosnia and Herzegovina, of the Federation of Bosnia and Herzegovina, of the Republika Srpska and of the District of Brcko.

LAW ON AMENDMENTS TO THE LAW ON COURT OF
BOSNIA AND HERZEGOVINA

Preamble

The Law on Court of Bosnia and Herzegovina (Official Gazette of Bosnia and Herzegovina No. 29/00, Official Gazette of the Federation of Bosnia and Herzegovina No. 52/00, Official Gazette of the Republika Srpska No. 40/00) (hereinafter the ‘Law’), as amended by Article 73 of the Law on High Judicial and Prosecutorial Council of Bosnia and Herzegovina is hereby amended as follows:

Article 1

Article 2 of the Law shall be deleted and the following new Article 2 shall be added:

‘The Court shall be composed of a President and a number of other judges as further defined by this law.’

Article 2

In Article 11, paragraph 1: after the words “budget of Bosnia and Herzegovina.” the following sentence shall be inserted:

‘Before the commencement of the budget year, the President of the Court shall present a budget proposal to High Judicial and Prosecutorial Council of Bosnia and Herzegovina. The President of the Court has the right to attend and to defend the High Judicial and Prosecutorial Council proposal at the sessions of the Parliamentary Assembly and its relevant committees whenever budgetary matters affecting the Court are discussed or decided.’

In Article 11, after paragraph 2: the following new paragraphs 3 and 4 shall be added:

‘3. The Court Budget shall include a separate item specifying the budget requirements for the work of the Special Panels for Organized Crime, Economic Crime and Corruption within the Criminal Division (hereinafter the ‘Special Panels’) and the Special Appellate Panel for Organized Crime, Economic Crime and Corruption within the Appellate Division (hereinafter the ‘Special Appellate Panel.’).

4. At the end of each budgetary year, the President of the Court shall inform the Parliament of Bosnia and Herzegovina of the execution of the budget of the Court.’

Article 3

In Article 19, paragraph 3: after the words ‘to any Division, Panel or case’, the full stop shall be deleted and the following words shall be inserted ‘except when otherwise defined by law.’

In Article 19, paragraph 5: after the words ‘appointed thereto by the President’, the full stop shall be deleted and the following words shall be inserted ‘except when otherwise defined by law.’

Article 4

In Article 21, paragraph 1 item b): after the words ‘to different divisions and panels’, the following words shall be inserted ‘as agreed by the Plenum of the Court;’

In Article 21, paragraph 1 item c): after the words ‘in case of disqualification of a judge’, the following words shall be inserted ‘as agreed by the Plenum of the Court;’

In Article 21, paragraph 1 item h): the word ‘judges’ shall be deleted.

Article 5

In Article 23, paragraph 1: the words ‘Criminal and’ and the word ‘each’ shall be deleted.

In Article 23, after paragraph 1 the following new paragraph 2 shall be inserted:

‘The Criminal Division shall consist of at least ten judges. It shall sit in panels of three judges.’

Article 23, paragraph 2 shall become ‘paragraph 3 and the words ‘at least five judges’ shall be deleted and the following words shall be inserted ‘at least ten judges.’

Article 23, paragraph 3 shall become ‘paragraph 4’and after the words ‘Appellate Division’ the following words shall be inserted ‘except in the Special Appellate Panel.’

Article 6

In Article 24 the following new paragraphs 1 and 2 shall be inserted:

1. ‘Special panels for Organized Crime, Economic Crime and Corruption shall be established in the Criminal Division.

2. A judge of the Special Panels shall not participate in the work of any other panel of the Criminal or Administrative Division.’

In Article 24 paragraphs 1.,2., and 3., shall become ‘paragraphs 3.,4.,and 5.,’ respectively.

Article 7

In Article 26, after paragraph 1: the following new paragraph 2 shall be inserted:

‘A Special Appellate Panel for Organized Crime, Economic Crime and Corruption shall be established in the Appellate Division to hear appeals against decisions of the Special Panels.’

Article 8

In Article 61, after paragraph 1: the following new paragraph 2 shall be inserted:

‘The Special Appellate Panel shall hear appeals against decisions of the Special Panels of the Criminal Divisions pursuant to the provisions of the Criminal Procedure Code of Bosnia and Herzegovina.’

In Article 61 paragraphs 2 and 3 shall become ‘paragraphs 3 and 4’ respectively.

Article 9

In Article 65, after paragraph 1: the following new paragraphs 2 and 3 shall be inserted:

2. ‘The Court shall have jurisdiction for crimes defined in the Laws of the Federation of Bosnia and Herzegovina, the Republika Srpska and the Brcko District which occurred prior to the entry into force of the Criminal Code of Bosnia and Herzegovina when those crimes include elements of international or inter-Entity crime as defined in the Criminal Code of Bosnia and Herzegovina.’

3. “When the Criminal Division of the Court is established and the Office of the Prosecutor of Bosnia and Herzegovina is established all courts in the Federation of Bosnia and Herzegovina, the Republika Srpska and Brcko District which have in their jurisdiction criminal cases, which fall under the jurisdiction of the Court pursuant to Article 65, paragraph 2, in which the indictment has not entered into force, shall be bound to transfer immediately the cases to the Office of the Prosecutor of Bosnia and Herzegovina. If the indictment has entered into force further proceedings will be conducted by the courts and prosecutors’ offices in the Federation of Bosnia and Herzegovina, the Republika Srpska and the Brcko District.”

Article 10

Entry into force

This Law on Amendments to the Law on the Court of Bosnia and Herzegovina shall enter into force eight days after the date of its publication in the “Official Gazette of Bosnia and Herzegovina.”

Article 11

Publishing of the Law

This Law on Amendments to the Law on the Court of Bosnia and Herzegovina shall be published in the “Official Gazette of Bosnia and Herzegovina”, “Official Gazette of the Federation of Bosnia and Herzegovina”, “Official Gazette of the Republika Srpska” and the “Official Gazette of the Brcko District of Bosnia and Herzegovina.”

Mozda, ali ti ne znas citati ni datume?
Колико ја могу да приметим, тај текст је о формирању суда у БиХ. Реално, суд треба да постоји и ту није ништа спорно. Оно што је спорно што су убрзо након формирање тог суда, тзв. Високи представници почели да раде шта хоће и да Републици Српској одузимају надлежности. Преко 80 надлежности је буквално отето од РС под притиском, уценама и принудом и томе се једном морало стати у крај.

Суд је требао бити фер и непристрасан али стално прати муслиманску реторику из Сарајева. Високи представници, као што рекох, су се буквално иживљавали над РС.

Тачно је да у том документу пише и следеће:
Recalling paragraph XI.2 of the Conclusions of the Peace Implementation Conference held in Bonn on 9 and 10 December 1997, in which the Peace Implementation Council welcomed the High Representative’s intention to use his final authority in theatre regarding interpretation of the Agreement on the Civilian Implementation of the Peace Settlement in order to facilitate the resolution of any difficulties as aforesaid “by making binding decisions, as he judges necessary” on certain issues including (under sub-paragraph (c) thereof) “measures to ensure implementation of the Peace Agreement throughout Bosnia and Herzegovina and its Entities”;

Тим колонијалним управницима су дата превелика овлаштења а они су их онда још и злоупотребљавали. О томе у РС говоре већ више од 15 година! Дакле, то што је суд формиран 2000-е те та одлука усвојена и у Скупштини РС 2002-e, 2023-e, није бланко чек да се онда и тај суд и тзв. Високи представници иживљавају над РС.

Треба ли ти већи доказ од овог суђења Додику? Њему су судили муслимани по члану закона који је Шмит сам дописао пре 2, 3 године а тај Шмит нема уопште потврду Савета безбедности да може бити тзв. Високи представник. Самим тим, Шмит је нелегитиман тзв. Високи представник и апсолутно не би требао да има било какву моћ у БиХ.

Да сами муслимани тј. Бошњацима имају било шта часно и поштено у себи, требали би се први дићи против таквих овлаштења које има неки странац (буквално је колонијални управник) а овај Шмит, уз то, још није ни потвђен од Савета безбедонсти.

Тог истог Додика је и та ваша СИПА контролисала више пута и поред свих прича о лоповлуку и крађи, малверзацијама, никад нису подигли оптужницу против њега због тавких ствари јер очигледно нису нашли никакве доказе али му зато судили по Шмитовом закону а Шмит нема овлаштење Савета безбодности да уопште буде у БиХ!

Шта ту, дакле, има нејасно?

Za neke od tih izmena i dopuna glasali su Dodikovi posaylnici 2003.

NIsi razumeo.Nevažno je potpuno da li je taj zakon usvojen i u parlamentu.Zakoni i druge odluke visokog predstavnika stupaju na snagu osmog dana od objavljivanja u službenim novinama.
Drugim rečima taj sud bi postojao u potpuno istom obliku i da nisu potvrdjene te izmene 2003 godine uz parlementu.

Poslanik Nenad Grković (Klub poslanika SDS – PDP – Za pravdu i red) je pitao Kojića, ako je sve kako je on naveo, “ako je sve neustavno, nelegalno, zašto je SNSD glasao za prenošenje nadležnosti, odnosno za formiranje ovoga i suda i tužilaštva”.

– Kako su to oni odjednom promijenili svoje mišljenje i kako odjednom taj sud i to tužilaštvo ne valja. Kada se to tužilaštvo i taj sud usudilo da pokrene postupak protiv samo jednog čovjeka, odjednom sada ništa ne valja, odjednom su sve to greške. Tada ste bili ‘dašak vjetra na Balkanu’ i tada vam to nije smetalo. I sve ostale nadležnosti koje ste prenijeli na nivo Bosne i Hercegovine sa nivoa RS-a, tada vam nije ništa smetalo, a nakon 20 godina sad odjednom je sve to velika greška – naveo je Grković.

Objašnjeno je sve oko datuma.Visoki predstavnici su više puta donosili odluke o tzv.sudu Bejha.Prva odluka je iz 2000 te i ista se odnosi na osnivanje.Kasnije su donosili brojne izmene i dopune.
"Verifikacija" odluka visokog predstavnika ne postoji u pravnom poretku Bejha.

Ni ovo nije tačno.Dodik se pobunio pre najmanje desetak godina protiv tog tzv.suda pa je došlo do određenih promena u pogledu strukture optuženih za ratne zločine.
Dodikova opozicija obmanjuje javnost i tako pokušava da prikrije svoju petokolonašku aktivnost i služenje neprijatelju i agresoru.
 
Objašnjeno je sve oko datuma.Visoki predstavnici su više puta donosili odluke o tzv.sudu Bejha.Prva odluka je iz 2000 te i ista se odnosi na osnivanje.Kasnije su donosili brojne izmene i dopune.

Poznajem dobro engleski i nemoj mi podmetati pravna objasnjenja, koja ni pravnici ne razuniju. Problem što naši političari generalno nemaju odgovornost za javno izgovorenu riječ. Tako da u dnevnopolitičke svrhe veoma brzo zaboravljaju šta su rekli i šta su mislili. S druge strane, narod se ponaša kao da ima kolektivnu amneziju.
Za Zakon o sudu BiH i Zakon o Tužilaštvu BiH svoj pristanak dali su zastupnici SNSD-a. Tačno je da je do prenosa nadležnosti došlo nametanjem odluka visokog predstavnika, ali SNSD ih je ozakonio. Da se to nije desilo, oni bi danas bili nametnuti zakoni i kao takvi neprimjenjljivi, morali bi se staviti u parlamentarnu proceduru, a tada bi postojao mehanizam da se to blokira.

Ne postoji ozakonjenje zakona ni drugih odluka visokog predstavnika,To su podmetanja opozicije koja služi veliokomuslimanskim ekspanzinostima i ostalim strancima u nasrtajima na autonoman status Srpske a pod izgovorom borbe protiv nepostojeće Dodikove diktature,strahovlade i drugim izmišljotinama.
Po tumačenju visokog predstavnika njegovim odlukama nije potreban ničiji pristanak.Iste su obavezujuće i bez potvrde u parlamentu koja ničemu i ne služi niti proizvodi neko pravno dejstvo .Od zakona koje je usvojio visoki predstavnik posledjnih nekoliko godina ni jedan nije usvojen u parlamentu Bejha ali ih tzv,sud Bejha i ustavni sud primenjuju.I sam Dodik je osuđen po takvom zakonu.
Opozicija u Republici Srpskoj je u stvari opozicija Republici Srpskoj.Poluga velikomuslimanske ekspanizonističke politike i stranaca.Guja u nedrima Srpske.
 
Pogedajte kako je dodikova stranka glasala 2002/3 da sud BiH bude nadlezan za RS. Mislim, da covjek ne povjeruje . . .

tipicno spinovanje srpske opozicije..u ovom momentu kad muslimani se trude svim silama da uniste postojanje RS, glupa opozicija se stavlja u ruke sarajevu jer spinuju sa glupim videom...normalno je da svaka zemlja ima sud...nakon rata je bilo bezakonje..ono sto nije normalno jeste da se taj sud nakon osnivanja stavlja uglavnom na stranu muslimana...to ne postoji ni u jednoj drzavi vec u banana bih...samim tim sto se stavlja samo u stranu muslimana taj isti sud je pogazio sve zakone...i sad opozicija sds spinuje, ona ista opozicija koja je prodala srpske gradove 95'...
 
tipicno spinovanje srpske opozicije..u ovom momentu kad muslimani se trude svim silama da uniste postojanje RS, glupa opozicija se stavlja u ruke sarajevu jer spinuju sa glupim videom...normalno je da svaka zemlja ima sud...nakon rata je bilo bezakonje..ono sto nije normalno jeste da se taj sud nakon osnivanja stavlja uglavnom na stranu muslimana...to ne postoji ni u jednoj drzavi vec u banana bih...samim tim sto se stavlja samo u stranu muslimana taj isti sud je pogazio sve zakone...i sad opozicija sds spinuje, ona ista opozicija koja je prodala srpske gradove 95'...
Prijatelju iz Venecuale, i meni je stalo do opstanka i dobrobiti RS-e, ali ovaj badza Dodo je konstantno urusava. Ko podrzava Dodu, podrzava propast RS. Da ima imalo savjesti, otisao bi sam. Zar mu nije dosta 20 godina? Prica da je opozicija izdajnicka je komunisticka mantra.
